Affiliate Terms

1. About these terms

These Affiliate Terms ("Terms") are a summary of the publisher agreement between Click Heist LLC ("ClickHeist") and any person or company approved to promote offers on the ClickHeist network ("Affiliate", "you"). The full agreement is accepted inside the platform at approval; if the two differ, the platform agreement controls. [Lawyer review] Align this summary with the platform agreement before launch.

2. Enrollment

  • Approval is at ClickHeist's discretion and may be withdrawn at any time.
  • You must provide accurate business, contact, tax, and payment details and keep them current. A valid tax form (W-9 or W-8 series) is required before the first payment.
  • One account per person or company unless approved in writing. Accounts may not be sold, transferred, or shared.
  • Each offer may require separate approval and carries its own payout, geos, caps, allowed traffic, and creative rules ("Offer Terms"). Offer Terms are part of these Terms.

3. Traffic rules

  • Run only the traffic types you declared and that the Offer Terms allow. Tell your manager before adding a new source.
  • Use only approved creatives, claims, and landing pages, or get written approval for your own.
  • Follow all applicable laws and platform policies, including the FTC Act and Endorsement Guides, CAN-SPAM, TCPA, state telemarketing and privacy laws, and the rules of any ad platform you use. See our Compliance page.
  • Include a clear and conspicuous affiliate disclosure wherever you promote an offer. Obtain and record valid consent before any call or text message.
  • Never collect or pass consumer personal information in sub-IDs, URLs, or tracking parameters beyond what the offer requires.

4. Prohibited methods

  • Incentivized, forced, or misleading clicks or conversions, unless the Offer Terms expressly allow incentives.
  • Bidding on or using an advertiser's brand, trademarks, or misspellings in paid search, domains, or ads without written permission.
  • Unsolicited email or SMS, purchased or rented lists without proper consent, spoofed sender identity, or missing opt-outs.
  • Cookie stuffing, forced redirects, iframes, toolbar or adware injection, typosquatting, or any technique that manufactures attribution.
  • Bot, proxy, data-center, or otherwise non-human traffic; duplicate or self-generated conversions; conversions from ineligible geos or devices.
  • False, unsubstantiated, or non-compliant claims, including fake reviews, fake scarcity, misleading pricing, or health and financial claims not approved for the offer.
  • Content that is unlawful, defamatory, adult, hateful, or that infringes third-party rights.

5. Tracking and attribution

ClickHeist's tracking system is the system of record for clicks, conversions, and payouts. You may use your own tracker via postbacks, but ClickHeist's records govern in a dispute. Report tracking problems within 48 hours of noticing them; we cannot credit conversions that were not tracked because of a problem on your side.

6. Payment

  • Payouts are calculated on approved conversions at the Offer Terms rate in effect when the conversion occurred.
  • Standard schedule: weekly, net 7 after conversion approval, with a $100 minimum, by Wire, PayPal, Payoneer, Wise. New accounts may start on a longer cycle until quality is established. [Lawyer review] Confirm the standard schedule and any currency, fee, and threshold rules.
  • Balances below the minimum roll over. Payment fees charged by your payment provider are yours.
  • ClickHeist may set off amounts you owe (for example, reversed conversions) against amounts owed to you.

7. Reversals and holds

Advertisers may reverse conversions that fail their quality criteria within the review window stated in the Offer Terms. Conversions that result from any prohibited method, or that the advertiser does not pay for because of your activity, are not payable. ClickHeist may hold payment while it investigates suspected violations, invalid traffic, or advertiser non-payment, and may withhold payment for conversions generated in violation of these Terms.

8. Confidentiality

Offer payouts, advertiser identities, performance data, and network communications are confidential. Do not publish or share them except with people who need them to run your campaigns and who are bound to keep them confidential.

9. Termination

Either party may end the relationship at any time with notice through the platform or by email. On termination, stop all promotion immediately. Approved conversions earned before termination are paid on the normal schedule, unless they were generated in violation of these Terms. Sections on confidentiality, payment set-off, liability, and governing law survive termination.

10. Liability, indemnity, governing law

You are responsible for your traffic and your compliance and will indemnify ClickHeist and its advertisers against claims arising from your promotions. ClickHeist's liability to you is limited to the payouts owed for the three months before the claim. These Terms are governed by Florida law, with exclusive venue in Pinellas County, Florida.
